New Jersey operates under a statewide mandatory Uniform Construction Code (UCC) system established by the State Uniform Construction Code Act of 1975 (N.J.S.A. 52:27D-119 et seq.). The UCC is administered by the Department of Community Affairs, Division of Codes and Standards, and applies uniformly across all 21 counties and 564 municipalities. Unlike many states, New Jersey prohibits local amendments to the building code—municipalities must enforce the state code as adopted. Current codes are based on the 2021 International Codes (I-Codes) with extensive New Jersey-specific amendments, effective September 6, 2022. Notable differences from model codes: - Plumbing: Uses National Standard Plumbing Code (NSPC) instead of IPC - Existing Buildings: Uses unique NJ Rehabilitation Subcode (N.J.A.C. 5:23-6) instead of IEBC - Energy: Low-rise residential uses IECC-R 2021; commercial uses ASHRAE 90.1-2019 - Electrical: Uses NEC 2020 (NFPA 70-2020) Climate Zones: Zone 4A covers 14 southern/central counties; Zone 5A covers 7 northern counties. Ice barrier requirements apply statewide per NJ DCA Bulletin 07-3 and IRC R905.1.2. Special Regulatory Areas: - CAFRA (Coastal Area Facility Review Act): NJDEP regulates coastal construction in 239 municipalities along Atlantic coast and tidal waterways - Flood Hazard Areas: N.J.A.C. 7:13 (Flood Hazard Area Control Act Rules) imposes additional requirements for construction in flood zones - REAL Rule (2025): New regulations adding 5 feet to FEMA base flood elevation for tidal flood hazard areas Licensing: All construction officials, subcode officials, and inspectors must be licensed by DCA. Categories include: Construction Official, Building Subcode Official, HHS Building Inspector, ICS Building Inspector, Electrical Subcode Official, Fire Subcode Official, Plumbing Subcode Official, and others. Ordinary Maintenance Exemption: N.J.A.C. 5:23-2.7 provides extensive list of work classified as "ordinary maintenance" not requiring permits, including: roof covering repair/replacement on one- and two-family dwellings, siding repair/replacement up to 25% in non-residential, window/door replacement in same opening, and specific plumbing, electrical, and HVAC items.
