New Mexico operates under a statewide mandatory building code system administered by the Construction Industries Division (CID) of the Regulation and Licensing Department. The state has 33 counties and approximately 105 incorporated municipalities. CID enforces codes directly through three regional offices (Albuquerque, Santa Fe, Las Cruces) except in jurisdictions with certified full-service building departments (notably Albuquerque, Santa Fe, Las Cruces, Rio Rancho, Los Alamos, and several other cities). Climate zones present: 3B (southern/lower elevations), 4B (central/mid-elevations), 5B (northern/higher elevations), 6B (high mountain areas), 7B (highest elevations). The state uses a city-specific climate zone table based on heating/cooling degree days in NMAC 14.7.6. Statewide requirements include: (1) Residential fire sprinkler prohibition - the Commission cannot require residential sprinklers in 1-2 family dwellings per NMSA § 60-13-6(E); (2) All contractors must be licensed (GB-2 residential requires 2 years experience, GB-98 commercial requires 4 years); (3) Flat roof/canales provisions specific to Southwestern architecture; (4) Earthen Building Materials Code (NMAC 14.7.4) for adobe/rammed earth construction common in the region; (5) Blower door testing required only in specific urban counties (San Juan, Sandoval, Santa Fe, Bernalillo, Torrance, Dona Ana) per NMAC 14.7.6.12. Special zones include WUI fire areas (Los Alamos County adopted IWUIC 2021 in May 2025), FEMA flood zones along Rio Grande and tributaries, and generally low seismic risk (SDC B). Farm/ranch construction is exempt from permits except for electrical wiring connected to external power sources per NMSA § 60-13-3(D)(12).
