West Virginia operates under a voluntary local adoption model where the State Fire Commission promulgates the West Virginia State Building Code (87 CSR 4), but enforcement occurs only in jurisdictions that affirmatively adopt it. The state has 55 counties and approximately 230 municipalities. As of 2017, approximately 70+ municipalities and 10 counties had adopted the State Building Code in some form. Climate zones present: 4A (Mixed-Humid) covering the majority of counties, and 5A (Cold-Humid) covering higher-elevation counties in the eastern mountains and northern panhandle. Key statewide requirements include: (1) Fire protection of floors required in new residential construction per 87 CSR 4 §5.1—options include 1/2" gypsum, 5/8" structural panel, dimensional lumber ≥2x10, or automatic sprinklers; (2) Agricultural buildings are fully exempt from the State Building Code per W. Va. Code §15A-11-5(a); (3) Contractor licensing required through the WV Contractor Licensing Board for any work ≥$2,500 total cost; (4) Homeowner exemption allows owner-occupants to perform work on their own residence without a contractor license. Energy code: Residential follows 2015 IECC with amendment allowing 5 ACH50 air leakage (versus 3 ACH50 in standard IECC). Commercial follows ASHRAE 90.1-2013. IRC Chapter 11 (Energy Efficiency) is specifically exempt from the State Building Code. Special considerations: Mine subsidence risk in coal mining counties (primarily southern and western counties) requires special foundation considerations. Flood hazard areas are present throughout the state with FEMA Special Flood Hazard Areas mapped via the WV Flood Tool. Historic structures registered on the State or National Register of Historic Places have modified code requirements per W. Va. Code §15A-11-5(g).
